CONTENT
The bill would amend the Michigan Election Law to provide a one-time extension of the date for counties, cities, and townships to submit, to the Michigan Department of Treasury, a request for the reimbursement of costs associated with the 2020 presidential primary. Current law requires requests for reimbursement to be submitted to the Department of Treasury no later than 90 days after the date of the presidential primary. Ninety days following the May 10, 2020, presidential primary was June 8, 2020. The bill would extend the deadline to September 30, 2020.
Additionally, the bill would eliminate existing provisions related to compensation of costs from processing voter identification cards. Current language requires the State to compensate cities and townships for costs associated with processing voter identification cards for the sole purpose of changing or adding a voter's political party preference. The bill would eliminate this language.
FISCAL IMPACT
The bill would require the State to reimburse any counties, cities, or townships that missed the original submission deadline for costs associated with the 2020 presidential primary. The exact cost is indeterminate and would depend on the actual amount of reimbursements requested by the proposed September 30, 2020, deadline.
Based on information received by the Department of State, there were a total of four counties and 156 cities and townships (see the table below) that did not submit a request for reimbursement by the original June 8, 2020, deadline. A total of $18.0 million was appropriated in FY 2019-20 for reimbursements to counties, cities, and townships and the amount of reimbursements that were requested by the June 8, 2020, deadline totaled $17.2 million. This leaves an estimated $800,000 available for reimbursements for those that could submit for reimbursement by the proposed September 30, 2020, deadline.
According to the Department of State data, the reimbursements for the 2020 presidential primary increased by an average of 38%. If all four counties and 156 cities and townships submitted for reimbursements by September 30, 2020, the total of reimbursements are estimated at $650,000 (assuming the same 38% increase from their 2016 reimbursements). If the actual amount of reimbursements exceeded the estimated $800,000 that remains available, the Legislature is statutorily required to appropriate the funds necessary to meet the obligation.
